A Delhi Court directed police to preserve the video footage of raid

New Delhi, Dec. 28(UNI): A Delhi Court after hearing a petition directed the Delhi Police to preserve the entire video footage of raid conducted at Advocate Mehmood Pracha’s house in connection with a case related to the Delhi riots.
Pracha had filed an application before the court and submitted that he was threatened by the Investigating Officer(I.O.) while the search was underway at his office on December 24.
He submitted before the court that under the provisions of Criminal Procedure Code the Investigation Agency should have intimated the concerned Magistrate about the search and the seized articles immediately and he was also entitled to have a copy of the footage.
Delhi Police has moved an application under the provisions of Criminal Procedure Code for conducting the search and after hearing the same court allows police to inspect any place in which an offence is alleged to have been committed for appreciating the evidences in connection with a Delhi riots-related case.
The Court after hearing allowed the plea of police by accepting the contentions and refused to supply the copy of the video footage at this stage.
Police had searched the office of Pracha by alleged false evidence and forged notary stamps were used to secure bail of an accused arrested in a riots case. Police alleged the complaint letter used to get bail in the case was sent from the computer of Pracha’s office.
Metropolitan Magistrate Udhav Kumar Jain after hearing the petition passed a directions to police to preserve the video footage with its seal and place it before the court concerned for necessary orders.
The Court stated that directions for preserving the video footage are only necessary and the concerned court can decide on supplying the video footage to Mehmood Pracha at the correct stage and adjourned the matter for January 5.
