Court orders to register case against Sirsa, others

New Delhi, Aug 23 : A Delhi Court on Tuesday ordered to resister a case against President of Delhi Sikh Gurudwara Management Committee Manjinder Singh Sirsa and others after hearing a complaint of forgery, criminal breach of trust against them.
The court passed an order to registration a case of forgery, criminal breach of trust for the purpose of cheating under the relevant provisions of Indian Penal Code.

The court heard the complaint against Sirsa and Avtar Singh Hit, President of Takht Shri Patna Sahib Management Committee, Patna Sahib, Bihar, President of Sukho Khalsa Primary Educational Society and also a Member of DSGMC, Sudeep Singh, (Media Advisor of DSGMC).
Complaint was filed by Manjit Singh G.K, President of Jag Asra Guru Ott, a registered religious party.

G.K was also former president of Delhi Sikh Gurudwara Management Committee (DSGMC) between 2013 and 2018.

Complainant alleged that both Manjinder and Avtar, in connivance with others, forged the signature of the complainant on the letter head of DSGMC dated 04.04.2016 to grab the property of Guru Harkrishan Public School, Hari Nagar, New Delhi which is under the administrative control of DSGMC since its inception. He said that the property comprises of 2.99 acres of land and approximate value of the property is 500 crores.

He submits that he held a Press Conference on 14.02.2020 unearthing the truth regarding the property of the said school where after the accused persons forged the aforesaid letter. It is also stated that on 18.02.2020, Sukho Khalsa Primary Education Society through its President Avtar Singh Hit filed a suit claiming to be the owner of said school and annexed the alleged forged letter to procure a favourable order from the Court.

Complainant submits that he came to know about the forged letter from the official Press Release of DSGMC through Sudeep Singh from its official e-mail ID on 23.02.2020.

He further submits that by making false statements and issuing false documents, the accused persons have tried to grab the property of Guru Harkrishan Public School, Hari Nagar, New Delhi from DSGMC and also caused defamation of the complainant and therefore, they are liable to be punished for offences under Section 120B, 420, 467, 468, 471, 409, 465 read with Sections 463, 464, 468,471, 499, 500, 501, 502 of Indian Penal Code(IPC).

Counsel for complainant has vehemently argued pressing upon his application for registration of FIR against the alleged accused persons by submitting that complainant has approached not only the Police Station concerned but also the office of DCP concerned seeking police investigation of this matter and registration of FIR, but of no avail.

After hearing the submission the court observed ,”It is manifest from the inquiry reports that Complainant Manjit Singh G.K as well as Accused Manjinder Singh Sirsa, both have given their respective complaints to the police with respect to forgery of a document on the letter head of DSGMC. From the perusal of alleged forged letter, it appears that the purpose for which it has been made is transfer of property at Guru Harikishan Public School, Hari Nagar, Delhi, which is valued at approximately 500 Crores.”

The court said, “From the above discussion and from the inquiry reports filed on record, it is apparent that prima facie case of forgery, criminal breach of trust and forgery for the purpose of cheating may be made out apart from other offences. Thus, this is fit a case which requires thorough and scientific investigation to determine how the letter head of DSGMS was obtained, the actual intent behind writing the alleged forged letter and most importantly, to determine the handwriting/ signatures on the same. The role of alleged accused persons is also required to be investigated in detail for which police investigation is required as complainant is not in a position to collect evidence.”

“It is hereby made clear that this order shall not affect the merits of the case or tantamount to giving an opinion on the commission of the alleged offences. Police is directed to conduct fair and independent investigation in this matter by collecting relevant evidence to bring out the truth,” the court concluded.

Additional Chief Metropolitan Magistrate Vidhi Gupta Anand after hearing arguments said the present application of the Complainant Manjit Singh G.K. seeking for registration of FIR stands allowed and Inspector, EOW is directed to register an FIR under relevant provisions of law and conduct investigation as per rules and file a compliance report along with copy of FIR on August 25, 2022.
