HC upheld disqualification of BJP councilor

Himachal Pradesh High court on Wednesday upheld the order to disqualify ruling party councilor of Shimla Municipal Corporation Sanjeev Sood from the Shimla Municipal Corporation on the based on a complaint against him.
This order was passed by the Division bench of Himachal Pradesh High court comprising acting Chief Justice Mr Ravi Malimath and Justice Joytsana Rewal on Aug 17 based on a writ petition filed by a Rakesh Kumar.
The petition stated that the BJP nominated councillors Sanjeev Sood should be disqualified as MC members under sec 8(20 -r) of HP Muncipal Corporation Act 1994 by the Director Urban Development. Director, Urban Development passed the order on the alleged submission of a false affidavit by the councillor before the department while filing his nomination
The petitioner said that the councillor have encroached upon government land and made an illegal construction over 5.25 square meter and elevated as MC member illegally. He also filed a complaint before the Urban Development Director in the matter.
The respondent did not oppose the petition in the court or the order passed by the UD Director disqualifying him from the post, the HC said in its final order .
